Your Traffic Ticket can be charged under "State Law", contrary to the Michigan Vehicle Code, or under "Local Ordinance." State Law violations are all found in and authorized by the Michigan Vehicle Code. Local Ordinance violations are those set forth by a municipality or township by authority of the Michigan Vehicle Code. All violations issued by the State Police or by the Sheriff's Department are State Law Violations. Most tickets issued by local police departments can be charged under either State Law or Civil Ordinance. Parking tickets are typically Civil Ordinance violations.

Your case can be a Civil Infraction or a Misdemeanor. Most Traffic Tickets are "Civil Infractions", which means that there is no "criminal penalty", (e.g. no jail time), associated with the offense. However, there are a number of Traffic Violations which are Misdemeanors and carry a potential criminal penalty. A Misdemeanor conviction will not only appear on your driving record but also appear on your criminal record. Your attorney at The Law Offices of THOMAS J. TOMKO and Associates, P.C. will be able to explain whether your offense is a Civil Infraction or a Misdemeanor. Call 586-795-8822 (Macomb or St. Clair), or 248-656-7722 (Oakland or Wayne), for an in-office appointment, or request a Free E-Mail Case Analysis.
