Penalties To Expect In Misdemeanor Cases

You and your attorney can influence the Court's discretion at sentencing. Penalties imposed will vary based on your charge(s), your background, and your Judge. WHAT YOU DO FROM THE DATE YOU ARE CHARGED THROUGH THE DATE OF SENTENCING CAN MEAN THE DIFFERENCE BETWEEN JAIL TIME AND PROBATION! In certain cases, this can have an enormous impact on the Judge. Should you expect community service? What fines should you expect? Will there be drug testing or reporting probation? To find out the likely sentence range in your case, contact an attorney at The Law Offices of THOMAS J. TOMKO and Associates, P.C. at 586-795-8822 (Macomb or St. Clair), or 248-656-7722 (Oakland or Wayne), and make an appointment, or request a Free E-Mail Case Analysis. Your attorney can explain the law and help you prepare your BEST DEFENSE to the charges in your case.

Will I Go To Jail?

In most Misdemeanor cases, where you face a first offense, it's unusual to go to jail. Should you have a more extensive record, or should there be unusual circumstances in your case, then jail may be more likely. It is always within the discretion of the judge to impose jail time or not. The outcome will differ by Court, by your prior record, and by the facts in your case. NO OUTCOME CAN BE GUARANTEED BY YOUR ATTORNEY OR THE PROSECUTOR. However, with the help of your attorney, you can greatly influence the Judge's decision to impose jail time or not.

What If I Get Probation?

If you are placed on Probation, it may be "reporting" or "non-reporting." If "reporting," you will typically meet once a month with a Probation Officer.

You may need to do things while on probation. These things can include: Education Classes, Community Service, Counseling, Drug or Alcohol treatment, or NA or AA Meetings. You also could be randomly tested for drug or alcohol use.

Your charge and your background will often influence the sentence. Ask your attorney at The Law Offices of THOMAS J. TOMKO and Associates, P.C. by calling 586-795-8822 (Macomb or St. Clair), or 248-656-7722 (Oakland or Wayne), to make an appointment, or request a Free E-Mail Case Analysis. What If I Violate My Probation?

If you violate a condition of your probation, then you could serve the entire un-served balance of jail time in your case! You also face new conditions of probation, extended probation, and in some Courts, a Contempt Charge!
